I have discovered the city of Milwaukie is planning to do some improvement along SE Lake Road in MIlwaukie Oregon.  Part of this improvement is to add a sidewalk on the South side of the street.  It appears in a document I have obtained the cities intention is to remove fifteen (15) 80 year old cedar trees that are currently behind a fence and on my property.  Not sure where I should start to find the rights the city would/could have to take property I own.

You realize you haven't posted on a Milwaukee, OR-centric board, yes?  (If you do, you should know that mentioning this or that particular road, etc. is meaningless to the reader here.)


I suspect you will find that the city probably has an easement right as to a particular wide swath of your property (even if it doesn't, there's a thing called eminent domain under which they could actually take ownership of property that you might have to fight).  I suggest you discuss with a local real estate attorney.
