The Landlord has indicated to the tenant that they will be applying rental payment to the water and late fee first than the remainder to the rent. Can this be done?

Yes (unless the lease prohibits it), although I'm not sure what difference it makes.

What does the lease agreement state about this matter? To learn more about your rights as a tenant, consider signing up for a legal plan on LegalStreet. For less than $13 a month, you can ask a local Virginia lawyer all the legal questions you want and also get discounted legal representation if you need.
