The Landlord has indicated to the tenant that they will be applying rental payment to the water and late fee first than the remainder to the rent. Can this be done?
When you pay rent in Virginia can the landlord apply it to water and late fee first then the rent portion?

Yes (unless the lease prohibits it), although I'm not sure what difference it makes.
