Can a spouse move funds from a 401k that clearly is community property to a separate savings account only in his/her name? Would the entire account then become community property?

Is it legal to plant a GPS tracking device in the car your spouse drives without telling your spouse? The title of the car is in both names. Do actions like this influence the judge in a divorce?

Can one spouse spend sizeable amounts of money from the community checking/savings account without permission of the other spouse? If the confronted spouse then lies about his/her actions does it influence the judge in a divorce?

I don't see how the answer could possibly be anything other than yes.


Would the entire account then become community property?


Maybe. Maybe not. Rather obviously, it depends on the relevant facts and that applicable state law.

Influence the judge to do what? You've provided almost no relevant facts and provided no context. Nor did you identify your state.

Probably not, but it depends on the laws of your unidentified state.

I have no idea what other actions you think would fall into the category of "actions like this." As for this particular action, I can't imagine why it would be relevant to anything but, as with your other posts, you've provided few relevant facts, no context, and didn't identify your state.

Of course it is illegal. And you may have some problems while doing that. And even if you will succeed she may use a GPS signal zapper, so all your efforts will be totally useless.

And you know this even though the poster didn't identify his/her state? That's impressive. Can you cite laws for all 50 states (and DC) that make this illegal?
