I was offered a position contingent on my background check.  I answered no and denied ever having an arrest as I did have one in 2009 but my record was expunged, or so I thought.  When they received my background check back it showed the arrest.  I have provided a copy of the expungement order from the court that I had, and based on my attorney from the case did not have to disclose any information because technically it never existed any longer.  They are now reviewing the offer to me.  Can they legally rescind the offer to me?  If the expungement had been processed correctly they would have never even known about it.  Now because of someone's error I might lose the chance at a job paying $50K per year.  The job offer is in FLorida.  The court case was back in 2009 in TN.  Any help someone can provide would be greatly appreciated.
