sexual harrassment

I work in Illinois and on an asbestos removal team. Well I have worked for it for 1 1/2 years and a guy has always made comments about me. Well let me start by saying this guy that is making the comments is one of the Alfa dogs and always likes to be in charge.


I am a thinner guy and almost 50. I was married for almost 20 years and have 2 children. I was also in the U.S. Navy for 20 years.


Well as an Asbestos removal team member you have to shower out a lot when you are leaving containment and you have to change out of your regular clothes into bathing suites and then back from your bathing suit to your regular clothes.


Well this one guy is always making comments about me about me being a "meet Gazzer". We are usually with around 8 guys and when I come into the room from containment or whatever, he makes comments about my sexuality.


I have never done a gay thing and am not gay. I have now started to experience headaches and am getting very self concious. I have asked him to stop and it keeps going on. I feel I have no choice but to file charges and file a law suit against him.


I hope there is help for me.

Huh?  Did you mean "gazer"?

I'm not sure what you mean by "file charges."  Nothing you've mentioned is criminal.  You did not say that you have complained to your boss and/or the other guy's boss and/or your employer's human resources department.  Any particular reason why you wouldn't do that before suing someone?

You are free to tell your employer that this behavior is unwelcome and you find it offensive.  If the employer does nothing about it and the person doesn't knock it off, you may try again or file a complaint with the EEOC and the state equivalent and, perhaps, talk with an attorney.


This isn't a matter of filing a lawsuit against this guy personally, but addressing it via employer's legal obligations to have a workplace free of unlawful harassment of, in this case, a sexual nature.

Meanwhile you discuss with a medical professional how to deal with the stress issues.
