I am in Nebraska. I own (pay on a morgage) a single family house. I agreed to allow my fiances son, girfriend, the girlfriends brother and the girlfriends 3 kids (ages 5, 5, and 7) to live in and pay rent in our house, a roomin the basement (WITHOUT a written agreement, unfortunatly). they have unlimed access with no time or date restrictions to the following areas of the house:
3) Dining Room
4) Laundry room
As I understand privacy laws, these are common areas (all except for the bathroom) and therefore a tenant or landlord would not have a reasonable expectaition of privacy. I have a few video cameras that DO NOT record sound set up in areas 1, 2, 3, and 4. When they go into one of these areas, they tamper with the camera (move it around so they are not seen by it) they are stating they have a "right to privacy" and we are "violating" it [the right to privacy]. One of the tenants states that because they like to go from the basement to the bathroom (located upstairs) in no more then birthday suit and a towel covering private areas.
I informed them the tenants) that they would not "run through the house" like that if there were other people in the room. They agreed to that but say they have the "right" not to be video taped/monitored.
We also have various cameras that watch the outdoor areas and our private areas (these are the areas the tenants are aware they are not permited in at any time without prior approval) inside the house (our bedroom, my private office, and the server room) these are there so I can see if someone goes in there that is not to be there (trespassing). They (the tenants are aware that the cameras are in our private areas, and do not dispute this) All cameras are fully visible and have the little blue light that tells the person that sees the camera that they may be being watched at that moment.
The reason the cameras are there is two fold:
1) My fiance has a brain injury and I need to be able to "look in" on her when I am at work (all cameras have a secure remote internet access feature)
2) I need to be able to see what is going on in the common areas, as there have been accusations of food theft and such from one another.
I have read some of the federal and state statutes. From what I can tell, it looks like I am legal. I am writing here to see if I am correct. Thank you in advance.
